8. Data transfer delays
Definition: A batch transfer is the means by which we receive data from third party suppliers, an electronic transfer of the data. There is necessarily a delay between data being provided to the third party supplier, their inputting the data onto their data system and this being sent to us and loaded into our systems at the time of the check. Our Guarantee is effective in respect of searches undertaken after the time we received and loaded the data or should have received the data.

8.1 We do not guarantee any claim arising from the normal delay understandably and reasonably associated with the transfer of data from the supplier to us. These unavoidable delay periods, the exemptions, are as follows:
a: Stolen. We do not guarantee checks or purchases that occur before we received the data in the relevant batch transfer. This will be considered an event before the data could be in our possession and therefore excluded from the Guarantee.
b: Written Off. We do not guarantee checks or purchases that occur before we received the data in the relevant batch transfer nor do we guarantee checks or purchases that occurred before the insurance company has concluded their involvement in any claim giving rise to a total loss categorisation and / or before the insurance company releases the vehicle for disposal and placed the VRM on MIAFTR.

9. Claims Procedure
9.1 If you wish to make a claim under the Guarantee, you must inform us as soon as possible after you become aware of the events giving rise or potentially giving rise to the claim (and in any event within the Guarantee Period). To start the claims procedure please email service@carcheck.co.uk.
9.2 We will issue a claim form for you to complete and return, together with evidence of the Enquiry, your proof of purchase for the Vehicle and other relevant documentation. Your claim will be dealt with by our administrators, who will contact you promptly.
